Classification of Handlers and Carriers

Definitions
- Licensing: Permission to engage in transporting animals.

- Various dealers (Livestock, Poultry, Milk, Egg, Hide, Skin, Manure and Dung, Game Fowl) are defined based on their business activities.
- Carriers (Land, Water, Air) defined based on type of transport vehicle and business.
Application Requirements
- Different documentation required based on business structure (Sole proprietorship, Partnership, Corporation).
- Common requirements include notarized application form, tax identification number, business permit, ID pictures, and vehicle registration where applicable.
- Submission of a self-addressed envelope.
Mandatory Seminar
- Applicants must attend a seminar addressing proper handling, disease control during shipment, quarantine rules, and responsibilities.
- Refusal or failure to attend disqualifies applicant from licensing or accreditation.
Registration, Licensing, and Accreditation Procedures
- Applications processed by BAI or through Department of Agriculture-Regional Field Units (DA-RFU).
- DA-RFU and Provincial Veterinarians assist in evaluation and endorsement.
- Only the BAI Director has authority to approve licenses and accreditations.
- Licenses and certificates are non-transferable and must be in possession during business operations.
Cooperating Agencies
- Include BAI, DA-Regional Field Units, Department of Interior and Local Government, Provincial and Local Government Units, Veterinarians, National Quarantine Veterinary Services, Philippine National Police, National Meat Inspection Commission, Philippine Ports Authority, and Philippine Coast Guard.
Duration and Renewal
- Validity of license and accreditation is one year.
- Renewal to be done at least one month before expiration.
- Renewal applicants must attend updating seminar on current rules and regulations.
Fees and Charges
- Handlers and dealers pay P300 for license.
- Transport carriers pay P500 per vehicle or vessel, except tricycles/trailers (P300).
- Fees collected remitted to the Bureau of Animal Industry account with proper documentation.
Monitoring and Reporting
- BAI's Marketing Development Division compiles monthly list of licensed handlers and accredited carriers.
- Copies distributed to relevant units for verification and enforcement.
- Checkpoints established by BAI, DA-RFUs, and Provincial Veterinarians with coordination from other agencies.
- Authority to revoke, cancel licenses, impose fines on violators vested mostly with BAI.
Penalties
- Violators of transportation rules may be sanctioned under Republic Act 7394.
- Licenses and accreditations may be revoked after hearings.
- Government employees failing to enforce regulations may face administrative charges.
Repealing Clause
- Conflicting rules and regulations are repealed or amended accordingly.
Effectivity
- Order effective 30 days after publication and filing with the U.P. Law Center.
