Law Summary
Conditions for Salary Adjustments
- Salary increases must comply with a uniform standard: all positions within the same department, office, corporation, or other entity must first be adjusted to the minimum authorized salary range applicable to their respective classifications.
- Only after all salaries in the entity are adjusted to their minimum ranges can any individual salary be increased beyond the minimum.
Provision for Previous Government Salary Considerations
- If an officer or employee previously received a higher salary during their government service, they may be granted a salary rate within the authorized range of their current position that does not exceed the lower amount between their previous salary or the authorized salary for the position.
Effective Date and Implementation
- The provisions under this amendment shall take effect retroactively from July 1, 1958.
- This ensures a uniform implementation date for all adjustments and increases covered by the Executive Order.
Legal and Administrative Authority
- Enacted under the presidential powers vested by law, specifically by President Carlos P. Garcia.
- The order reinforces standardized pay practices to promote equity and proper salary structuring within the national government workforce, controlled by WAPCO’s classification system.
Key Legal Concepts
- Emphasis on uniform salary structure and equitable adjustment across government entities.
- Recognition of past salaries in determining current pay to avoid salary reduction for government employees moving between positions or agencies.
