Manuel L. Quezon's Executive Order No. 237 amends price controls on essential goods, establishing maximum selling prices for various food items and materials while excluding government purchases of higher quality products from these limits.

Authority and relationship to EO No. 233

  • Paragraph (3) of Executive Order No. 233 is amended by Executive Order No. 237.
  • Tables appended by Executive Order No. 233 are supplemented through Executive Order No. 237 by adding specific “Table No. 93” and other named tables as integral parts of Executive Order No. 233 (Section 2).

Brand coverage and price application rule

  • The maximum prices in the attached schedules for listed articles (including milk, sardines, corned beef, vegetable lard, sugar, wheat flour, galvanized iron sheets, plain galvanized wire, steel bars, nails, motor fuel alcohol, gasoline, petroleum, cement, mongo. meat, corn, and rice) apply to the respective brands specified in the schedules (Paragraph (3) as amended).
  • The same maximum prices also apply to “such other brand or class” of the same articles as the Emergency Control Administration determines to be of the same or similar quality or class upon proper application (Paragraph (3) as amended).
  • Until the Emergency Control Administration makes such determination, any new brand or class of the articles listed in the schedules cannot be sold at a price higher than the maximum price fixed for the lowest-priced brand or class of that same article (Paragraph (3) as amended).
  • New brand/class price control continues for both articles listed in the existing schedules and any future schedules appended to the maximum-price system (Paragraph (3) as amended).

Government procurement exemption for higher-spec goods

  • The maximum prices fixed in Executive Order No. 233, as amended, do not apply to purchases made by the Government of the Commonwealth of the Philippines or any of its sub-divisions, agencies, and instrumentalities (Paragraph (3) as amended).
  • The maximum prices fixed in Executive Order No. 233, as amended, also do not apply to purchases made by the Government of the United States or any of its agencies and instrumentalities (Paragraph (3) as amended).
  • The exemption applies when such purchases require articles of higher quality and different specifications than the articles ordinarily required in the schedules (Paragraph (3) as amended).

Appended tables become integral parts

  • Table No. 93 is appended as an integral part of Executive Order No. 233, fixing maximum prices for “Mother” condensed milk and “Farma” and “Morrning” evaporated milk (Section 2).
  • Table 95 appends maximum prices for “Golden Star” condensed milk and “Golden State” evaporated milk (Section 2).
  • Table 96 appends maximum prices for “Royal” evaporated milk (Section 2).
  • Tables 99 to 102 append maximum prices for specified brands of tinapa sardines and sardines, including “Tanibana,” “Del Monte,” “Palacea,” “Majida,” “Mikia,” “Brisa de Oro,” “Asia,” and “S & W.” (Section 2).
  • Tables 103 and 105 append maximum prices for specified brands of sardines and corned beef, including “Royal” sardines and corned beef, respectively (Section 2).
  • Table 106 appends maximum prices for “Ranchero” corned beef (Section 2).
  • Table 111 appends maximum prices for “Rizala” petroleum (Section 2).
  • All the tables listed in Section 2 are appended to and made integral parts of Executive Order No. 233 (Section 2).

Revisions to previously fixed maximum prices

  • Maximum prices in Executive Order No. 233 for specified condensed milk brands—“Hollandia,” “Molino,” “Frisian Flag,” “Royal” and “Dutch Baby” condensed milk—are revised according to the attached tables Nos. 94, 95, 96, 97, 98 (Section 3).
  • Maximum prices in Executive Order No. 233 for specified evaporated milk brands—“Alpine,” “Nestle,” “Milkmaid,” “Dutch Baby,” “Frisian Flag,” and “All Pure” evaporated milk—are revised according to the attached tables Nos. 94, 95, 96, 97, 98 (Section 3).
  • Maximum prices in Executive Order No. 233 for specified sardines brands—“No. 1,” “White Star,” “Portola,” “P.C.C.,” “El Rayo,” “Concha,” “Bandera,” and “Mayona” sardines—are revised according to the attached tables Nos. 99 and 103 and related listed tables Nos. 94, 95, 96, 97, 98 included in the revision set (Section 3).
  • Maximum prices in Executive Order No. 233 for specified articles and brands—“Emery,” “Libby’s,” “Armour,” and “Hereford” corned beef for vegetable lard—are revised according to the attached tables Nos. 104, 105, 106, 107, 108 (within the revision set) (Section 3).
  • Maximum prices for flour, gasoline, and petroleum are revised according to the attached tables Nos. 107, 108, 109, 110, 111, 112 (within the revision set) (Section 3).
  • Executive Order No. 237 expressly states that the revisions are as shown in the attached tables Nos. 94, 95, 96, 97, 98, 99, 103, 104, 105, 106, 107, 108, 109, 110, 111 and 112 (Section 3).

Effectivity and operation timing

  • Executive Order No. 237 takes effect in the manner and form provided under Paragraph 6 of Executive Order No. 233 (Section 4).
  • The maximum prices and table amendments operate only after the effectivity method in Paragraph 6 of Executive Order No. 233 is satisfied (Section 4).
