Legal basis and predecessor provision amended
- Executive Order No. 210 is issued by the President of the Philippines.
- Executive Order No. 210 amends Section 3 of Executive Order No. 603.
- Executive Order No. 603 is titled “Creating a Light Rail Transit Authority, VESTING THE SAME WITH AUTHORITY TO CONSTRUCT AND OPERATE THE LIGHT RAIL TRANSIT (LRT) PROJECT AND PROVIDING FUNDS THEREFOR.”
Purpose for changing Board composition
- Executive Order No. 210 states that Executive Order No. 603 created a corporate body known as the Light Rail Transit Authority.
- Executive Order No. 210 states that the reorganization of the Department of Transportation and Communications under Executive Order No. 125, as amended requires changes in the Board of Directors composition of the Authority.
Amended Section 3: Board composition
- Section 1 amends Section 3 of Executive Order No. 603 to govern the Authority’s Board of Directors.
- The powers and functions of the Authority are vested in an exercised by the Board of Directors composed as follows:
- The Secretary of Transportation and Communications as Chairman.
- The Secretary of Finance, Secretary of Economic Planning, Secretary of Public Works and Highways, and Secretary of Budget and Management.
- The Chairman of the Land Transportation Franchising and Regulatory Board.
- The Governor of the Metropolitan Manila Commission.
- The Administrator of the Authority.
- All officials enumerated under Section 3 are ex-officio members.
- Section 3 also provides for one (1) representative from the private sector, appointed by the President, who serves a two (2) year term.
Alternates, absences, and temporary presiding officer
- Section 3 provides that officials next in rank to, or such officials duly designated by the regular members, serve as alternate members.
- Alternate members attend Board meetings and committees assigned to them by their principals.
- Alternate members receive the corresponding per diem when their principals are absent or their positions are vacant.
- Section 3 provides that when the Chairman is absent, the Board elects a temporary presiding officer.
Compensation: representation allowance and per diem caps
- Section 3 requires that the Chairman and each Member of the Board receive a monthly commutable representation allowance of One Thousand (P 1,000.00) Pesos.
- Section 3 requires a per diem of Two Hundred (P 200.00) Pesos for every meeting of the Board actually attended.
- Section 3 limits total per diem payable to each member such that the total per diem each may receive shall not exceed One Thousand (P 1,000.00) Pesos a month.
Transitory and implementation rules
- Section 2 provides that Executive Order No. 210 takes effect immediately.
- Section 1 operates by amending Section 3 of Executive Order No. 603 to reflect the updated Board composition, alternates, and compensation rules.
