Legal basis and cited law
- The Secretary of Agriculture issues the Order pursuant to Section 18, Chapter 4, Title IV, Book IV of Executive Order No. 292.
- The Secretary issues the Order under the provisions of RA 7394, known as The Consumer Act of the Philippines.
- The Order states that imports without the required permit are subject to the pertinent provisions of RA 7394 and existing DA Quarantine rules and regulations.
Policy and purpose
- The Order declares a need to strengthen agriculture quarantine services.
- The Order declares a need to harmonize existing import rules and regulations in line with increasing global trade.
Scope: what imports are covered
- The Order expands the scope of DA A.O. No. 4, s. 1998 beyond agricultural products.
- The Order covers LIVE ANIMALS; PLANTS; FISHES and their products and by-products, in addition to agricultural products.
- Imports covered include agricultural products and their products and by-products.
- The Order includes a specific exclusion for companion animals (except horses) and other non-food animals not listed as endangered species under CITES, when accompanied by a Veterinary Health Certificate from the country of origin.
Import permit and health certificate requirements
- The Order requires an Import Permit (SPS Certificate) prior to importation of Agricultural Products; Live Animals; Plants; Fishes; their products and by-products.
- The Order requires that the importation be accompanied by a Sanitary/Phytosanitary/Health Certificate from the country of origin.
- The Order makes the permit requirement applicable to the listed categories of imports before importation.
What happens with imports without permits
- Agricultural products; live animals; plants; fishes; and their products and by-products imported without the required Import Permit are deemed illegal.
- Illegal imports are subject to the pertinent provisions of RA 7394.
- Illegal imports are also subject to existing DA Quarantine rules and regulations.
Revocation of inconsistent issuances
- The Order revokes all existing Orders and Issuances that are inconsistent with its provisions.
- Inconsistent issuances are revoked, repealed, and/or amended accordingly.
