Extent of Liability of the State Insurance Fund

  • The liability of the State Insurance Fund is exclusive and replaces all other employer liabilities for compensation claims.
  • Payment under this Title does not preclude recovery of benefits under other laws such as the Revised Administrative Code, GSIS and SSS laws, and related statutes.

Commission's Powers and Budget Management

  • The Employees' Compensation Commission has the duty to adopt an annual budget for its operations, charged against the State Insurance Fund.
  • The Social Security System (SSS) and Government Service Insurance System (GSIS) must advance the commission's operational expenses quarterly based on the approved budget.

Death and Funeral Benefits

  • Primary beneficiaries receive monthly income benefits upon death of the covered employee, plus 10% additional for each dependent child, maximum five children. Benefits are guaranteed for five years.
  • If no primary beneficiaries exist, secondary beneficiaries receive monthly income benefits but not exceeding 60 months.
  • Minimum death benefit is set at 15,000 pesos.
  • In cases where the covered employee was under permanent total disability at death, primary beneficiaries get 80% of the monthly income benefit plus dependents' pension.
  • Secondary beneficiaries get monthly pensions excluding dependents' pension for the remainder of the guaranteed period.
  • Funeral benefit of 1,500 pesos is payable upon the death of a covered employee or permanently totally disabled pensioner.

Prescriptive Period for Claims

  • Compensation claims must be filed within three years from the time the cause of action accrued, or the claim will not be acknowledged.

Repeal and Effectivity

  • All laws, decrees, or orders inconsistent with these provisions are repealed.
  • The decree takes effect on June 1, 1984.
