Penalties Based on Amount Involved

  • If the amount involved does not exceed 200 pesos: Prision correccional (medium and maximum periods).
  • If the amount is more than 200 pesos but does not exceed 6,000 pesos: Prision mayor (minimum and medium periods).
  • If the amount is more than 6,000 pesos but less than 12,000 pesos: Prision mayor (maximum period) to reclusion temporal (minimum period).
  • If the amount is more than 12,000 pesos but less than 22,000 pesos: Reclusion temporal (medium and maximum periods).
  • If the amount exceeds 22,000 pesos: Penalty from reclusion temporal (maximum period) up to reclusion perpetua.

Ancillary Penalties

  • Perpetual special disqualification from public office.
  • A fine equal to the amount of the funds malversed or the total value of the property embezzled.

Effectivity of the Act

  • The Act took effect immediately upon approval on June 12, 1954.
