Law Summary

Time Limits for Delivery of Detained Persons

  • For crimes punishable by light penalties or their equivalent, the detainee must be delivered within twelve (12) hours.
  • For crimes punishable by correctional penalties or their equivalent, the detainee must be delivered within eighteen (18) hours.
  • For crimes punishable by afflictive or capital penalties or their equivalent, the detainee must be delivered within thirty-six (36) hours.

Obligations of Public Officers and Employees

  • Public officers or employees who detain persons on legal grounds are obligated to deliver these persons to the proper judicial authorities within the specified time limits.
  • Failure to comply with these time limits shall result in penalties as provided in the preceding article of the Revised Penal Code.

Rights of the Detained Person

  • The detained individual must be informed immediately of the cause of their detention.
  • The detainee has the right to communicate and confer with their attorney or counsel at any time upon request.

Repeal and Modification of Inconsistent Provisions

  • All laws, orders, issuances, rules, and regulations or parts thereof inconsistent with this Executive Order are repealed or modified accordingly.

Effectivity of the Executive Order

  • The Executive Order takes effect thirty (30) days following its publication in the Official Gazette.
  • The order was signed by the President of the Philippines and the Executive Secretary on July 25, 1987.
