Legal basis and amendment focus

Purpose for public safety

Amended Article 125: Core rule
- Article 125 governs delay in the delivery of detained persons to the proper judicial authorities.
- The penalties in the next preceding article are imposed on the public officer or employee who detains a person for some legal ground and fails to deliver the detained person to the proper judicial authorities within the prescribed period (Article 125).
- The applicable delivery period depends on the penalty classification of the crime or offense:
- 12 hours for crimes or offenses punishable by light penalties, or their equivalent (Article 125).
- 18 hours for crimes or offenses punishable by correctional penalties, or their equivalent (Article 125).
- 36 hours for crimes or offenses punishable by afflictive or capital penalties, or their equivalent (Article 125).
- The required delivery period applies to detention “for some legal ground” (Article 125).
Mandatory detainee safeguards
- In every case, the detained person must be informed of the cause of his detention (Article 125).
- Upon the detainee’s request, the detainee must be allowed, at any time, to communicate and confer with his attorney or counsel (Article 125).
Repeal of inconsistent issuances
- Section 2 provides that all laws, orders, issuances, rules and regulations, or parts thereof inconsistent with Executive Order No. 272 are repealed or modified accordingly.
Effectivity and publication rule
- Executive Order No. 272 takes effect 30 days following its publication in the Official Gazette (Section 3).
