Taxation and Collection Method
- The court designates the shares of the government bodies and allocates the remaining seven-tenths of costs among land lots and owners.
- A statement of taxation and apportionment is sent to the provincial treasurer.
- No cost is apportioned against lots previously surveyed or registered.
- The amount charged to each lot is a special tax assessment and constitutes a first lien.
- It is payable in five equal annual installments with 6% interest.
- Installments align with the schedule for general land taxes.
- Owners may prepay installments before their due dates.
Certification and Payment Procedures
- The Director of Lands certifies monthly statements of cadastral survey expenditures.
- The Insular Treasurer pays the Bureau of Lands an amount equal to certified expenditures, appropriated from the Insular Treasury.
- The Insular Treasurer also pays the Judiciary for the cost of registration proceedings.
- Payments from provinces, municipalities, townships, and landowners are paid into the Insular Treasury.
Optional Assumption of Costs by Provincial Governments
- Provincial governments may, with Governor-General approval, opt to pay the seven-tenths of costs charged to landowners in addition to their own one-tenth share.
- In such cases, payments by owners are made as outlined, but funds go to the provincial treasury as general funds.
Effective Date
- The provisions of this Act take effect upon its passage.
