Application for Development Permits for Subdivision Projects
- In cities/municipalities not yet assuming devolved function under EO 71, or those that indorse function to HLURB, the same conditional rules for development permits as condominiums apply.
Application for Certificates of Registration and License to Sell for Subdivision and Condominium Projects
- Applications may be processed even if certain permits, certifications, or approvals from other agencies are pending.
- For subdivisions, pending documents may include:
- Development Permit from LGU
- DENR approval of Survey Returns
- NWRB Certificate of Public Convenience or local water utility certification
- Certification from MERALCO or local power cooperative
- Environmental Compliance Certificate or Certificate of Non-Coverage
- Order of Conversion or Certificate of Exemption from DAR
- For condominiums, pending documents may include water and power certificates, and filed Master Deed and Declaration of Restriction.
- Acceptance of applications is conditional on submission of proof of filing for these certifications and permits.
- Publication of notice for subdivision projects requires proof of plan approval by Sangguniang Bayan, though conditional publication without Development Permit may be allowed with Supervising Commissioner's consent.
- No project is considered registered, nor receives Certificate of Registration, without submission of Development Permit.
Issuance of License to Sell
- No License to Sell shall be issued until all necessary permits, approvals, and certificates from appropriate agencies and public utilities have been secured.
Processing Timeframe and Administrative Sanctions
- All applications for Registration and Licensing must be processed and completed within thirty (30) days from submission of complete documentary requirements, except those requiring actions from other agencies.
- Failure of the Regional Office to act within prescribed period may result in administrative sanctions under existing Civil Service laws.
Effectivity and Superseding Provisions
- The guidelines take effect immediately upon adoption on 7 February 2001.
- They supersede any prior inconsistent rules or issuances.
