Eligibility Criteria for Appointment

  • City Fiscal:
    • Must be a Filipino citizen.
    • Must have practiced law in the Philippines for at least ten years or held a government office requiring legal practice for a similar period.
  • Assistant Fiscal:
    • Must be a Filipino citizen.
    • Must have practiced law for at least five years or held a similar government post requiring legal practice for a like period.

Salary Scale

  • City Fiscal: ₱12,000 per annum.
  • First assistant City Fiscal: ₱11,600 per annum.
  • Three second assistant city fiscals (division chiefs): ₱11,000 each per annum.
  • Assistant fiscals categorized into salary brackets ranging from ₱6,000 to ₱10,000 annually according to their grouping and functions.

Organizational Division of the Office

  • The City Fiscal organizes the office into three divisions to enhance efficiency:
    • Preliminary Investigation Division: Handles all preliminary investigations of crimes and city ordinance violations exclusively.
    • Prosecution Division: Responsible solely for prosecuting criminal cases.
    • Miscellaneous Division: Represents the city in civil cases involving the city or its officers in official capacity, provides legal opinions, drafts ordinances, contracts, bonds, and reviews such documents prior to approval.

Organizational Flexibility and Transition Provisions

  • The City Fiscal may reorganize the three divisions as needed by service demands.
  • The City Fiscal retains authority to assign assistant fiscals to investigate and prosecute the same case collectively if deemed necessary.
  • Existing assistant fiscals at the time of the law’s approval shall retain their positions, duties, and receive corresponding salary adjustments without needing reappointment.

Effectivity

  • The Act takes effect immediately upon approval, ensuring the continuity of the office's functions and organizational structure with enhanced provisions.
