Legal basis and governing authority
- The President issues the order by virtue of powers vested in the Presidency by law.
- The order cites Executive Order No. 336 (January 5, 2001) as the basis for the National Council for Civil Aviation Security’s responsibility to formulate plans to direct, control, supervise, and integrate measures to prevent and suppress terrorist threats to civil aviation.
- The order cites Section 31, Chapter 10, Title III, Book III of the Administrative Code of 1987 as authority for the President’s continuing power to reorganize the administrative structure of the Office of the President.
Policy purpose and security need
- The order recognizes the urgent need to safeguard civil aviation against acts of unlawful interference.
- The order balances security aims with safety, regularity, and efficiency of flights.
- The order is anchored on preventing and suppressing terrorist threats to civil aviation.
National Civil Aviation Security Programme adoption
- The National Civil Aviation Security Programme (NCASP), attached as Annex “A”, is approved and adopted.
- The NCASP is the governing national program for aviation security purposes under the order.
Creation of Office for Transportation Security
- An Office for Transportation Security is created under the Department of Transportation and Communication(s) (DOTC).
- The Office is headed by an Undersecretary.
- The Undersecretary is primarily responsible for implementing Annex 17 of the International Civil Aviation Organization (ICAO) Convention on aviation security.
Reconstitution of aviation security committee
- The National Council for Aviation Security is reconstituted as the National Civil Aviation Security Committee (NCASC).
- The NCASC is composed of the following members:

NCASC powers and implementation duties
- In addition to its current functions, the NCASC is responsible for the implementation and maintenance of the NCASP.
- The NCASC must:
- Define and allocate tasking and coordinate activities among government agencies, airport authorities, aircraft operators, and other concerned entities for implementing various aspects of the NCASP.
- Coordinate security activities among those agencies and entities responsible for implementing various aspects of the NCASP.
- Define and allocate tasks for implementing the NCASP among those agencies, airport authorities, aircraft operators, and other concerned entities.
- Ensure that each airport serving international civil aviation establishes and implements a written airport security programme appropriate to meet the requirements of the NCASP.
- Arrange for an authority at each airport serving international civil aviation to be responsible for coordinating the implementation of security controls.
- Arrange for the establishment of an airport security committee at each airport serving international civil aviation to assist the airport authority in coordinating the implementation of security controls and procedures.
- Coordinate and collaborate with the Task Force for Security of Critical Infrastructure under the Cabinet Oversight Committee on International Security.
- Perform such other transportation security functions and serve as the Secretariat of the NCASC.
Repeal and effectivity rules
- The order repeals or modifies accordingly all orders, rules, regulations, and issuances, or parts thereof, inconsistent with the Executive Order.
- The order takes effect immediately upon January 30, 2004 in City of Manila.
