Penalties Imposed

  • Fine ranging from Php10,000.00 to Php200,000.00 per day for each day the violation persists.
  • Imprisonment from two (2) to six (6) years.
  • Possible combination of both fine and imprisonment.
  • Penalties imposed by General Manager upon Public Hearing Committee recommendation.

Due Process and Enforcement Mechanisms

  • Notice and hearing must be given prior to penalty imposition.
  • Authority empowered to issue ex parte orders for closure, suspension, or cessation of operations pending resolution of the case.

Liability of Corporate Entities

  • If the violator is a corporation, partnership, or association, the President or Chief Executive Officer is held liable for the violation.

Effectivity

  • Resolution takes effect 15 days after publication in a newspaper of general circulation and registration in the National Administrative Register.
