Scope of Violations and Offenses Subject to Penalties
- Covers violations of Article V of LLDA environmental regulations.
- Includes failure to renew discharge permits within prescribed periods.
- Encompasses prohibited acts or omissions under Section 27 of RA 9275 and its implementing rules.
Penalties Imposed
- Fine ranging from Php10,000.00 to Php200,000.00 per day for each day the violation persists.
- Imprisonment from two (2) to six (6) years.
- Possible combination of both fine and imprisonment.
- Penalties imposed by General Manager upon Public Hearing Committee recommendation.
Due Process and Enforcement Mechanisms
- Notice and hearing must be given prior to penalty imposition.
- Authority empowered to issue ex parte orders for closure, suspension, or cessation of operations pending resolution of the case.
Liability of Corporate Entities
- If the violator is a corporation, partnership, or association, the President or Chief Executive Officer is held liable for the violation.
Effectivity
- Resolution takes effect 15 days after publication in a newspaper of general circulation and registration in the National Administrative Register.
