All pawnshops are mandated to comply with the Know Your Pawner Policy by verifying the ownership of pawned items and requiring valid identification documents, with strict penalties for non-compliance.

Authority and covered entities

  • The Bangko Sentral ng Pilipinas (BSP) issues the memorandum to ensure compliance by pawnshops with existing regulatory duties.
  • The memorandum applies to ALL PAWNSHOPS, including their OWNER(s), PARTNERS, BOARD OF DIRECTORS, MANAGEMENT and EMPLOYEES concerned.

  • Sanctions and penalties for such violations are governed by Sections 17 and 18 of Presidential Decree No. 114 (Pawnshop Regulation Act).
  • Additional penalties are governed by Sections 4199P and 4399P of MORNBFI-P.
  • The memorandum also ties penalties to Section 14 of Republic Act No. 9160 (Anti-Money Laundering Act of 2001) and Section 36 of Republic Act No. 7653 (New Central Bank Act).
