Definition of Habitual Criminal

  • A person convicted of any of the specified crimes three times or more within the prescribed 10-year period.

Sentencing for Habitual Criminals

  • Upon the third conviction:
    • Sentence includes the penalty for the last crime committed.
    • Court may impose an additional imprisonment of 3 to 9 years.
  • Upon the fourth conviction:
    • Sentence includes penalty for the last crime.
    • Additional imprisonment of 10 to 15 years may be imposed.
  • Upon the fifth conviction:
    • Sentence includes penalty for the last crime.
    • Additional imprisonment of 16 to 20 years may be imposed.
  • Upon the sixth or subsequent convictions:
    • Sentence includes penalty for the last crime.
    • Additional imprisonment ranging from 21 to 30 years may be imposed.

Discretion of the Court

  • The additional penalties are discretionary, allowing judges to tailor sentences within the prescribed ranges.

Repeal Clause

  • Repeals Act Numbered 3062 to the extent it conflicts with this Act.

Effectivity

  • The law took effect on January 1, 1928.
