Required Attachments for Surety Bond Submission
- Certified copy of a valid Certificate of Accreditation and Authority issued by the Office of the Court Administrator, which must include a photograph of the authorized agent.
- Copy of the Certificate of Compliance with Circular No. 66 issued by the Insurance Commission, duly certified by the Insurance Commission.
- Secretary’s Certificate containing the specimen signatures of agents authorized to transact business with the courts.
Validity Requirements of the Surety Bond
- The surety bond's validity must extend for at least ninety (90) days beyond the date when the pertinent court order becomes final and executory.
Filing Procedure and Compliance
- Upon submission, if the surety bond complies with all the listed requirements, the appeal along with the bond will be forwarded to the Department of Labor and Employment (DOLE) for appropriate action.
- If any of the required documents or conditions are not met, the appeal will be denied processing and an Entry of Judgment will be issued instead.
Enforcement and Compliance
- The guidelines are mandatory and strictly enforced to ensure proper administration and legal compliance in the handling of supersedeas bonds for appealed cases.
- This directive applies universally to all parties involved in the filing of surety bonds with the POEA docket and enforcement division.
