Prescription Periods Based on Penalties

  • Offenses punished only by a fine or imprisonment of not more than one month (or both): prescribe after 1 year.
  • Offenses punished by imprisonment of more than 1 month but less than 2 years: prescribe after 4 years.
  • Offenses punished by imprisonment of 2 years or more but less than 6 years: prescribe after 8 years.
  • Offenses punished by imprisonment of 6 years or more: prescribe after 12 years.
  • Exception: Crime of treason prescribes after 20 years.

Special Provision for Violations Administered by the Bureau of Internal Revenue

  • All offenses under laws administered by the Bureau of Internal Revenue prescribe after 5 years, regardless of penalties.

Prescription for Violations Penalized by Municipal Ordinances

  • All violations penalized by municipal ordinances prescribe after 2 months.

Prescription for Violations Involving Certificates of Public Convenience

  • Violations of regulations or conditions of certificates of public convenience issued by the Public Service Commission prescribe after 2 months.

Commencement of Effect

  • The act takes effect immediately upon approval on November 26, 1930.
