System Description

  • The System is a Trunked Radio System, not a Radio Telephone System.
  • Telephone interface is an optional feature, not the primary function of the System.

Authorized Users and Access

  • Access is limited to DOTC and its Sectoral Offices, Attached Agencies, Mt. Pinatubo Commission, and other national government agencies involved in disaster relief and rehabilitation, especially related to Mt. Pinatubo.
  • Other national government agencies may be authorized access by the Secretary or his authorized official.
  • Non-government organizations and private individuals generally are not permitted, except when assisting in emergencies and duly licensed as radio users.
  • All access and use must comply with this Circular and other applicable government issuances.

Fees for Operation and Maintenance

  • Users share expenses through fees charged at cost with the following fees:
    • Non-recurring charges: Access fee, programming fee, and installation fee per unit and Talk Group vary by device type (portable, mobile, base).
    • Monthly fees apply per unit and Talk Group, also varying by device type.
  • Transactions are strictly between DOTC and the authorized user groups; third parties like contractors or suppliers have no authority to transact with DOTC.

Proprietary Rights and System Security

  • System software and key programs are owned exclusively by DOTC.
  • Unauthorized use, control, or possession of software or key programs is illegal.
  • DOTC reserves the right to deny or cut off access, reject unauthorized radio units, and investigate suspected illegal activity.
  • Authorized users must provide their own radio units, acquired through approved sources.
  • Data classified as confidential or classified by the Secretary or authorized official are protected from unauthorized disclosure.

Repair, Maintenance, and Programming

  • Authorized users are responsible for repair and maintenance of their radio units.
  • Only compatible and properly programmed radio units will be authorized.
  • Programming is conducted only by authorized DOTC personnel.

Administrative Control and Monitoring

  • Access is restricted to radio units technically capable of being monitored by DOTC through "System Watch".
  • Units not susceptible to monitoring or those using technical concealment will be denied access.
  • Radio Call Signs are issued by ECPO/CPMO and linked to specific radio ID numbers.

Disabling Access and Liability

  • Any unit accessing the System without authorization or using unregistered Call Signs will be immediately disabled without notice.
  • DOTC has the sole authority to disable units violating laws, rules, or causing technical issues.
  • Accredited user groups are jointly liable for actions of their authorized radio users.

Requirements for Access

  • Prospective users must submit:
    • An official request signed by the agency head, affirming intention and compliance.
    • Certificate of Ownership indicating radio models and serial numbers.
    • Official receipts evidencing legitimate acquisition.
    • NTC-approved dealer report on units.
    • Written approval from authorized CPMO/DOTC official.
    • Memorandum of Agreement (MOA) with DOTC.
  • Additional documentary proof may be required by DOTC to verify legitimacy.

Memorandum of Agreement

  • MOA formalizes terms and conditions for System use.
  • Signing MOA is mandatory for access.

Enforcement and Effectivity

  • Violation of any provision may result in immediate denial or revocation of access.
  • Inconsistent previous issuances are modified or repealed accordingly.
  • Circular effective 15 days after registration with the University of the Philippines Law Center, compliant with the Administrative Code of 1987.
