Establishment of the Media Advisory Council
- Abolishes the previously created Mass Media Council under Presidential Decree No. 36.
- Creates the Media Advisory Council, chaired by the President of the National Press Club.
- A recognized civic leader is appointed co-chairman by the President of the Philippines.
- Membership includes one representative each from the Manila Overseas Press Club, print media, radio, television, and other members designated by the President.
Functions and Powers of the Media Advisory Council
- Responsible for approving applications of mass media entities seeking permission to operate.
- No newspaper, magazine, periodical, publication, radio, television, or telecommunication station/network may operate without first securing a Certificate of Authority from the Council.
- The Certificate of Authority is valid for six months and is renewable for successive six-month periods unless earlier terminated.
- Existing publications at the time of the enactment may continue under their current permit until expiration.
Approval and Validity of Certificates
- Certificates of Authority issued by the Media Advisory Council are not valid until approved by the President of the Philippines.
Rulemaking and Regulatory Authority
- The Council must organize itself immediately upon the decree's promulgation.
- It must promulgate rules, regulations, and guidelines within 15 days of its formation for mass media operations.
- The rules include sanctions for infractions, subject to Presidential approval.
- The Council assumes the functions and prerogatives of the former Philippine Press Council and the Press Consultatives Panel, insofar as consistent with this decree.
Organizational Structure and Reporting
- Authorized to establish a secretariat to perform its functions and duties.
- Required to submit monthly reports to the President detailing actions taken and recommendations on mass media operational matters.
Legal Status and Effectivity
- The decree forms part of the law of the land and takes immediate effect.
- It remains in force unless rescinded by the President or a duly authorized representative.
