Management of UC-EC

Limitation on Use of Environmental Charge
- The environmental portion of UC-EC is strictly limited to watershed rehabilitation and management, prohibiting diversion to other uses.
Petition and Reporting Requirements
- NPC must submit annually to ERC petitions for availment of UC-EC funds for watershed projects by March 15 each year as per Implementing Rules and Regulations (Rule 18, Section 4.b).
- Beneficiaries must provide PSALM with certified copies of ERC orders confirming entitlement to UC-EC funds.
Role of PSALM in Monitoring
- PSALM oversees remittance and disbursement from the Special Trust Fund (STF), ensuring funds are used for intended purposes.
- Requires prompt submission of relevant ERC rulings from beneficiaries to monitor disbursement effectively.
ERC's Role in Establishing Procedures
- ERC adopts and enforces "Rules and Procedures Governing the Utilization and Disbursements of the Universal Charge-Environmental Charge" to ensure transparency and compliance.
- Rules aim to facilitate timely dissemination of information and proper fulfillment of NPC's obligations under the Act.
Effectivity and Publication
- The resolution adopting these rules takes effect 15 days after publication in a newspaper of general circulation in the Philippines.
- Copies of the resolution to be furnished the University of the Philippines Law Center-Office of the National Administrative Register for official record keeping.
