20% Fare Discount for PWD under RA 10754

Republic Act No. 10754 expands benefits and privileges of Persons with Disability (PWD) and amends Section 32 of Republic Act No. 7277.
The circular is implemented through the framework that “corresponding Rules and Regulations (IRR)” have been issued pursuant to Republic Act No. 10754.
The circular cites Section 6.7 of the IRR framework on Land Transportation Travel, covering public utility land transport and related services.
The circular directs action consistent with Section 5 (k) and (l) of Executive Order No. 202.
The Board issues binding directions to public utility operators and drivers to grant the required discount.

The circular mandates a 20% discount on fares for Persons with Disability (PWD) when they avail themselves of covered transport services.

The 20% fare discount applies to land transportation travel and covered services referenced in the IRR framework under Section 6.7, including but not limited to:
- Public utility buses (PUB) and public utility jeepneys (PUJ),
- UV Express,
- Taxis,
- Asian Utility Vehicles (AUVs),
- Shuttle service,
- Public railways including Light Transit, Metro Rail Transit, and Philippine National Railways,
- Transportation Network Vehicle Services (TNVS).
The Department of Transportation, including agencies under its supervision and control, is recognized in the IRR framework as responsible for issuing guidelines, circulars, or directives related to domestic air, sea, and land transportation travel and disseminating information to concerned parties.
For TNVS and taxi service, the discount applies to the total fare granted to the PWD.

Public utility operators and drivers must grant a 20% fare discount to Persons with Disability (PWD).
The discount is required when the PWD avails of the covered transportation services.
For TNVS and taxi service, the full 20% discount applies to the total fare.
For TNVS and taxi service, the full 20% discount applies to the PWD regardless of the number of companions.
For other modes of transport (PUB, PUJ, UV Express), the 20% discount applies based on the amount of fare corresponding to the PWD.

A PWD must present an identification document to avail of the fare discount.
The identification document must include an Identification Card issued by the National Council for the Welfare of Disabled Persons.
The identification card must be issued by and recognized through duly authorized officials of the Local Government Unit (LGU) concerned.
The circular treats the identification document requirement as including identification documents such as, but not limited to, the specified identification card.

Any operator found in violation of the circular is subject to the following penalties:
- First Offense: PHP 5,000.00,
- Second Offense: PHP 10,000.00 and six (6) months Suspension of CPC,
- Third Offense: Cancellation of Franchise.

The Board issues a directive that all public utility operators and drivers grant the 20% fare discounts.
The circular’s directive is framed to apply across the covered land transportation travel modes covered by the RA 10754 transport benefit implementation.
The circular is ordered “SO ORDERED” and is adopted January 19, 2018, for immediate effect.
