RA 11279 transfers the Philippine National Police Academy (PNPA) and the National Police Training Institute (NPTI) from the Philippine Public Safety College (PPSC) to the Philippine National Police (PNP), amending related provisions of RA 6975, appropriating funds, and providing for transition arrangements.
RA 11279 amends Sections 24, 35, 66, 67, and 68 of RA 6975 to reflect (1) PNP administrative/operational supervision and control over PNPA and NPTI, and (2) updated provisions on PPSC/college functions and the structural placement of PNPA and NPTI.
The PNP is given administrative and operational supervision and control over the PNPA (under PD 1184, Sec. 13) and over the NPTI.
The NPTI is responsible for mandatory and leadership trainings of all police non-commissioned officers (PNCOs).
The NPTI is headed by a Director with the rank of Police Major General.
The PNPA is the premier institution for police education and the primary source for the commissionship of police lieutenants.
The Chief of the PNP has direct administrative and operational supervision and control over the PNPA.
The PNPA Director is a Police Major General; the Deputy Director is a Police Brigadier General. It also provides for a Dean of Academics and a Commandant, both with the rank of Police Brigadier General.
It transfers to the PNP the PNPA and NPTI personnel and all related properties, facilities, records, equipment, funds, choses in action, appropriations, rights, functions, liabilities, and other assets.
Within 120 days from effectivity, the Chief of the PNP must submit the revised table of organization and equipment and staffing pattern of PNPA and NPTI to the NAPOLCOM and the DBM for approval.
Personnel of PNPA and NPTI shall be transferred from the PPSC to the PNP and continue performing their duties and responsibilities while receiving corresponding salaries and benefits.
PNP, PPSC, PNPA, and NPTI must jointly conduct an inventory of all properties, facilities, records, equipment, funds, choses in action, appropriations, rights, functions, liabilities, and other assets prior to complete transfer.
For five (5) years from effectivity, PNPA may continue accommodating BJMP and BFP cadets. The period may be extended by the PNP upon request if the PPSC is still unable to provide required education and training.
DILG, in consultation with the PPSC, is authorized to create a separate academy for BJMP and BFP.
The budget required for per capita expenses for cadetship training during the transition period shall be included in the respective appropriations of the BJMP and BFP.
NAPOLCOM, in coordination with PNP, PPSC, and DILG, must promulgate necessary rules and regulations to implement RA 11279.
The amount necessary for initial implementation shall be charged against the current year’s appropriations of PNPA and NPTI under the PPSC; thereafter, continued implementation is funded through inclusion in the annual General Appropriations Act.
