Executive Order No. 141 transfers the Philippine National Construction Corporation (PNCC) from the Department of Trade and Industry (DTI) to the Office of the President (OP), streamlining the administrative structure and placing the PNCC under the direct supervision and control of the President.

Executive Order No. 141 transfers the Philippine National Construction Corporation (PNCC) from the Department of Trade and Industry (DTI) to the Office of the President (OP).

PNCC was attached to the DPWH under Executive Order No. 148 (s. 2002) for policy and program coordination and general supervision related to road networks development.

PNCC was attached to DTI due to the huge investment required in the development of expressways.

Paragraph 3, Section 31, Chapter 10, Title III, Book III of the Administrative Code of 1987 grants the President continuing authority to reorganize the administrative structure of the OP and transfer agencies between departments or to the OP.

The appointive directors of PNCC are appointed by the President from a shortlist prepared by the Governance Commission for Government-Owned or Controlled Corporations (GCG).

All issuances, orders, rules and regulations, or parts thereof inconsistent with EO No. 141 are repealed, amended, or modified accordingly.

The order took effect immediately upon its signing on October 14, 2013.

PNCC is described as an acquired asset corporation under the Asset Privatization Trust, which was under the Office of the President.

Executive Secretary Paquito N. Ochoa, Jr. signed the order by authority of President Benigno S. Aquino III.

The reasons include the origin of PNCC as an acquired asset under the Asset Privatization Trust which was under the OP, the President’s authority under the Administrative Code to reorganize agencies, and the need to align PNCC governance with legal mandates such as RA 10149.
