Under Book IV, Title XIV, Chapter 1, Section 4(8) of the Administrative Code of 1987, the function of issuing licenses and permits for activities related to aquatic resources, treasure-hunting, salvaging of sunken vessels, and similar activities was given to the DENR.
Because treasure-hunting involves hidden treasures which are not considered natural resources, the function of issuing treasure-hunting permits was deemed not properly vested in the DENR.
The President is authorized under Book III, Title III, Chapter 10, Section 31(2) of the Administrative Code of 1987 to transfer functions from the Office of the President to any executive department and vice-versa.
The Executive Order covers treasure-hunting licenses or permits including those for treasure-hunting within the territorial waters of the Philippines.
Executive Order No. 416 took effect immediately upon its signing on July 31, 1990.

It includes any licenses or permits for treasure-hunting activities over lands of the public domain, lands belonging to the National Government, government-owned and controlled corporations, local governments, as well as territorial waters of the Philippines.
