Q&A (EXECUTIVE ORDER NO. 45)

The purpose of Executive Order No. 45 is to transfer the attachment of the Development Academy of the Philippines (DAP) from the Office of the President (OP) to the National Economic and Development Authority (NEDA) for policy and program coordination.

The Development Academy of the Philippines (DAP) was created under Presidential Decree No. 205 (s. 1973), as amended.

DAP is mandated to promote and support the country's development efforts by carrying out human resource programs designed to instill development perspectives and advance management capability in key government and economic sectors.

Section 23, Chapter 8, Title II, Book III of Executive Order No. 292, or the Administrative Code of 1987.

NEDA is the primary agency responsible for formulating continuing, coordinated, and fully-integrated social and economic policies, plans, and programs.

Section 31, Chapter 10, Title III, Book III of Executive Order No. 292 provides the President the continuing authority to reorganize the administrative structure of the OP and transfer any agency to another department or agency.

According to Section 2 of EO No. 45, if any part or provision is held invalid or unconstitutional, the provisions not affected shall remain in full force and effect (separability clause).

EO No. 45 took effect immediately upon publication in the Official Gazette or in a newspaper of general circulation.
