Questions (Republic Act No. 9164)

The first synchronized barangay and sangguniang kabataan elections under RA 9164 are held on July 15, 2002.

Subsequent synchronized barangay and SK elections are held on the last Monday of October and every three (3) years thereafter.

Their term of office is three (3) years.

No. RA 9164 provides that no barangay elective official shall serve for more than three (3) consecutive terms in the same position.

The term of office is reckoned from the 1994 barangay elections.

It states KK is composed of Filipino citizens actually residing in the barangay for at least six (6) months, aged fifteen (15) but less than eighteen (18) on election day, and duly registered in the list of the sangguniang kabataan or in the official barangay list in the custody of the barangay secretary.

He/she must be: a Filipino citizen; a qualified voter of the KK; a resident of the barangay for at least one (1) year immediately prior to election; at least fifteen (15) but less than eighteen (18) years old on election day; able to read and write Filipino, English, or the local dialect; and must not have been convicted of any crime involving moral turpitude.

The Omnibus Election Code and other existing election laws apply to barangay and SK elections, as far as practicable.

COMELEC shall promulgate the necessary rules and regulations to implement RA 9164.

RA 9164 appropriates One billion one hundred million pesos (P1,100,000,000) needed for the purpose, charged from COMELEC’s appropriation authorized under the FY 2002 General Appropriations Act (RA 9162).

Savings of COMELEC not exceeding Three hundred million pesos (P300,000,000) may be used to augment said appropriations as authorized under COMELEC Special Provision No. 2 of RA 9162.

It takes effect seven (7) days after its complete publication in two (2) newspapers of general circulation.

The separability clause states that if any provision is declared unconstitutional or invalid, the remaining parts not affected remain in force. The repealing clause provides that all inconsistent decrees, executive orders, rules, and regulations, or parts thereof, are repealed or modified accordingly.
