Section 10, Article XIII of the 1987 Constitution, which provides that urban or rural poor dwellers shall not be evicted nor their dwellings demolished except in accordance with law and in a just and humane manner.
EO No. 82 (s. 1986) created the Presidential Commission for the Urban Poor (PCUP) under the Office of the President to coordinate the speedy implementation of government policies and programs for the urban poor.
It directed concerned government departments, agencies, and offices to coordinate with PCUP and actively participate in tri-sectoral dialogues and activities concerning the urban poor.
Republic Act No. 7279, the Urban Development and Housing Act (UDHA) of 1992.
Section 28 of RA No. 7279, as stated in the text of EO No. 69.
It directed PCUP to monitor all demolition and eviction activities involving the homeless and underprivileged citizens.
Section 1 orders the transfer of PCUP to the Office of the President (OP) to coordinate, formulate, and evaluate policies and programs concerning the urban poor.
PCUP shall undertake social preparation activities related to asset reform, human development and basic social services, employment and livelihood, and other government programs for the urban poor.
PCUP must participate in policy discussions in the board meetings of the Housing and Urban Development Coordinating Council (HUDCC), key shelter agencies (KSAs), Local Housing Boards (LHB), or other similar bodies.
PCUP, HUDCC, the Department of Social Welfare and Development (DSWD), the Department of Justice (DOJ), the Department of the Interior and Local Government (DILG), and the National Anti-Poverty Commission (NAPC), in coordination with the Commission on Human Rights (CHR).
Within forty-five (45) days from the issuance of the EO.
Ensuring strict compliance with Section 28 of RA No. 7279, and implementing the provisions of EO No. 69.
They must render full assistance and cooperation, and provide any other information and data required to carry out functions pursuant to the EO.
PCUP must submit quarterly reports to the Office of the President regarding the status of compliance with the EO and pertinent provisions of law governing eviction and demolition activities.
If any provision is declared invalid or unconstitutional, the unaffected provisions remain valid and subsisting.
All other executive issuances not consistent with EO No. 69 are amended, modified, or repealed accordingly.
