QuestionsQuestions (LTFRB MEMORANDUM CIRCULAR NO. 2008-009)
It aims to simplify the classifications of Tourist Transport Services to obviate confusion and misapprehension regarding the kind of tourist transport services and the units authorized under prior DOTC/LTFRB issuances.
The circular references several issuances, including Department Order No. 97-1097, and LTFRB Memorandum Circular Nos. 98-002, 2003-001, 2004-01, 2004-026, 2005-033, 2006-049, 2006-058, and related issuances.
It cites Department Order No. 2005-010 titled “Policy Guidelines on the Executive Authority and Functions by the LTFRB,” granting the Board authority to amend/modify previous orders governing route, capacity/classifications, zones, and areas of operation.
MC No. 2003-001 reclassified tourist transport services into: (1) Tourist Shuttle Service, (2) Tourist Metered Taxi Service, (3) Tourist Coupon Taxi Service, and (4) Tourist Chartered Service.
They were directed to be converted into: (1) Tourist Coupon Transport Service, (2) Tourist Chartered Transport Service, and (3) Tourist Rent-A-Car Transport Service.
It provides that the age requirement for all tourist transport services shall be ten (10) years from the date of manufacture (as referenced in the text).
City Tours Services.
It reiterated Rent-A-Car Transport Service as a sub-classification under Tourist Transport Services, specifying features such as luxurious vehicles and minimum requirements (e.g., minimum engine displacement/wheelbase as stated), and requiring a contract/service agreement basis for the CPC grant.
Corporate Transport Leasing Services under the Rent-A-Car subcategory.
They are: (1) Tourist Bus Transport Service, (2) Tourist Car Transport Service, and (3) Tourist Air-conditioned Jeep Transport Service.
It covers buses with a maximum capacity of sitting 60 passengers, and mini-coach/coaches, where the text states a minimum of 20 passengers (including coasters) and a maximum sitting capacity of 42 passengers and upwards.
It covers AUVs and cars/four-door sedans including metered or coupon taxis and Rent-A-Car Transport Service, either high-end/luxury or ordinary models. For Rent-A-Car Transport Service, the text requires a minimum engine displacement of at least 1300cc (to broaden participation).
The circular states both are authorized to serve tourist clientele under special rates and are not allowed to pick up and drop ordinary passengers on the return trip. A Tourist Metered Taxi uses a duly calibrated taximeter issuing receipt; a Tourist Coupon Taxi operates without the usual taximeter and charges predetermined rates paid upon departure using coupons with specified information.
The circular requires CPC holders to file the corresponding applications for conversion within six (6) months from the effectivity of the Memorandum Circular.
They must file corresponding amendments of their applications to conform to the three-category classification set forth in the circular.
All issuances (or pertinent parts of them) inconsistent with MC No. 2008-009 are modified accordingly or superseded/revoked.
