The Office for Transportation Security establishes comprehensive security measures for mishandled baggage to prevent the introduction of dangerous items into aircraft, ensuring that only authorized personnel handle baggage and that all mishandled items undergo strict security screening.

Questions (OTS TRANSPORTATION SECURITY REGULATIONS NO. 015-2010)

It is issued pursuant to Executive Order 277 as amended by Executive Order 311 designating the Office for Transportation Security (OTS) as the single authority in transportation security, to implement Annex 17 of the ICAO and Section 9.6 of the National Civil Aviation Security Program (NCASP).

Mishandled baggage is baggage involuntarily or inadvertently separated from passengers or crew.

To prevent weapons, explosives, or any other dangerous devices, articles, or substances from being introduced into the aircraft by establishing security measures for mishandled baggage.

The passenger must be on board the aircraft; otherwise, the baggage must have been subjected to other security control measures after determining the passenger is not on board.

Hold baggage must be accepted only from ticketed passengers and only by responsible agents or authorized representatives of the aircraft operator.

The baggage must be protected from unauthorized access until returned to the passenger at destination or transferred to another operator.

Access must be restricted to authorized personnel only.

Security personnel of the concerned aircraft operator, airport authorities/managers, and the PNP-AVSEGroup.

They must prevent unauthorized baggage from being placed on conveyor belts, carts, or vehicles, and ensure that loaded baggage carts are not left unattended in areas accessible to the public.

A storage area for mishandled baggage must be established in all airport terminals.

The concerned aircraft operator is responsible for any erasures, tampering, altering, or damaging of identifying marks and tags.

They must designate an appropriate storage area and establish a filing system to expedite claim by the rightful owners.

The concerned aircraft operator must be duly notified by the handler/loader or security personnel for appropriate action or possible passenger and baggage reconciliation.

All mishandled baggage must be subjected to security screening prior to storage using the Explosive Detection System (EDS) and/or an OTS Accredited Explosive Detection Dog (EDD) for suspicious baggage.

It must be reported to the concerned aircraft operator and the Explosive Ordnance Disposal (EOD) team for appropriate action.

A bomb dispersal area, with its location and construction determined by the airport authority/management using an OTS-approved design.

It is a ground for civil liability for any damage and injury to third persons.

They may be held civilly or administratively liable for any damage and injury caused to third persons, subject to existing laws.

It takes effect immediately after fifteen (15) days from publication in a newspaper of general circulation.
