QuestionsQuestions (DOTC DEPARTMENT ORDER NO. 2007-38)
Administrative Order (AO) No. 1 dated 19 February 1968 issued by the then DPW&C made it unlawful for any person or group of persons to drive a bicycle, tricycle, pedicab, motorcycle, or any vehicle not motorized to operate or traverse limited access highways.
DOTC DO No. 2007-015 designated and declared all expressways as Limited Access Facilities. DOTC DO No. 2007-38 therefore applies to motorcycles operating within these designated limited access facilities.
It is defined as a highway or street especially designed for through traffic, where owners/occupants of abutting land and other persons have no right of easement or only a limited right of access, light, air, or view because their property abuts the limited access facility or for other reasons.
Subject to conditions, motorcycle operation may be allowed because there are no intersections, no pedestrian crossings, no loading and unloading zones, and the highways are designed for through traffic.
Only motorcycles with an engine displacement of at least 400 cubic centimeters (cc) shall be allowed.
The motorcycles must comply with all provisions of RA 4136 (Land Transportation and Traffic Code), including: (1) roadworthiness, (2) safety standards issued by competent authorities, and (3) licensing requirements.
No. Motorcycles shall not lane-split and overtake in between lanes.
Motorcycles must follow the speed limits prescribed by law and/or by the tollway operators.
Motorcycles shall use the lanes normally used by other vehicles in accordance with safe motoring and practice.
Motorcycles must have their headlights on at all times to improve/enhance visibility to lawful users of the toll road(s) and limited access highway.
Their tail lights and turn signal lights must be operational at all times.
Motorcycles shall not be allowed to load cargo except for normally accepted saddlebags and luggage carriers specifically designed for the motorcycles.
Yes, the motorcycle operator is allowed one (1) back rider.
Both the motorcycle operator and the lone back rider must each use a protective motorcycle helmet.
The lone back rider must be provided with a seat and footrest in the motorcycle.
The motorcycle must be covered by a current and valid registration, and the operator must be a holder of a valid license, which the operator must be able to show at any time to competent authority if asked.
Motorcycle operators must pay the toll rate prescribed for Class 1 vehicles. They are encouraged to use electronic toll collection equipment (E-Pass/EC-Tag) when available.
Violations of any provisions of the order are punishable under Section 10 of RA No. 2000 (Limited Access Highway Act), as stated in the order.
It takes effect after fifteen (15) days following completion of its publication in a newspaper of general circulation.
