These rules and regulations apply to the implementation of Batas Pambansa Bilang 33 as amended by Presidential Decree No. 1865 issued on May 25, 1983, covering production, sale, transport, processing, blending, and packaging of petroleum products for business or profit.
Oil Companies are those that manufacture, process, and sell a broad range of petroleum products, including Caltex Philippines, Inc., Mobil Oil Philippines, Inc., Petrophil Corporation, and Pilipinas Shell Petroleum Corporation.
Illegal trading includes producing, selling, transporting, processing, blending, or packaging petroleum products for profit without prior registration and license from the Bureau of Energy Utilization, failure to issue official receipts, unauthorized refilling of LPG cylinders, and other violations specified in the rules.
All transactions must be covered by official receipts showing the seller's registered name and address, quantity, price, type of product, date, and for LPG cylinders, brand, gross weight, tare weight, net weight, unit price, and total price.
All LPG cylinders must be marked with their weight and owner’s trade name, distinguishing color, and serial number. After filling, cylinders must be sealed with a seal that must be broken to release the contents. Sealing must comply with Bureau approval.
Dispensing pumps must not deliver less than the actual quantity by more than 50 milliliters per 10 liters measured. Underdelivering pumps are subject to penalties and must be marked out-of-order until recalibrated.
Penalties include preventive suspension for up to 30 days, fines up to P10,000, suspension of license, or revocation of license by the Bureau of Energy Utilization.
Petroleum products that do not meet PSA specifications or contain water or other substances forming separate layers exceeding allowable limits are considered adulterated. Sale, distribution, or possession of such products is prohibited.
Calibration and sealing must be done by authorized entities such as the Municipal or City Treasurer, NSTA, or other government agencies. Oil companies may provide provisional calibration in absence of an authorized agency.
Hoarding is refusal to sell available products without good cause, undue accumulation beyond normal inventory levels, or refusal to sell during normal business hours when payment is offered in cash. It is prohibited and punishable under the Act.
