This administrative order establishes the rules and procedures for issuing collective Certificates of Land Ownership Award (CLOAs) to Agrarian Reform Beneficiaries, allowing for co-ownership and subsequent individual titles while ensuring the protection of members' interests within cooperatives and farmers' associations.

The Order governs the rules and procedures for the issuance of collective Certificates of Land Ownership Award (CLOAs) and the subsequent issuance of individual titles to co-owners under the agrarian reform program pursuant to RA 6657.

The Order recognizes three types: on co-ownership basis, to farmers' cooperatives, and other forms of farmers' collective organization.

All private agricultural lands, public lands within DAR settlement projects, and lands turned over to DAR by other government agencies under EO No. 407, as amended by EO No. 448, that are subject to the Comprehensive Agrarian Reform Program (CARP).

The total collective land area shall not exceed the number of co-owners or members multiplied by the three-hectare award limit, except in meritorious cases approved by the Presidential Agrarian Reform Council (PARC).

Subdivision is based on the actual occupancy of each Agrarian Reform Beneficiary (ARB) not exceeding three hectares per owner, following an approved subdivision plan and a notarized Deed of Partition executed by all co-owners.

Issuance of individual titles is subject to the Land Registration Authority procedures pursuant to the Land Registration Decree (PD 1529), and the ten-year conveyance restriction is reckoned from issuance of the collective CLOA.

The Department of Environment and Natural Resources (DENR) - Land Management Service (LMS) is responsible for verifying and approving subdivision surveys.

PARO processes subdivision requests, prepares deeds of partition, retrieves owner’s duplicate titles, and transmits documents to the Register of Deeds. DARRO awards and supervises the subdivision surveys and submits approved plans to the PARO.

The names of the cooperative or association and the individual members with their fractional shares must be annotated to protect members from unjust separation and secure their ownership interests.

The Order takes effect ten (10) days after its publication in two national newspapers of general circulation and supersedes all inconsistent previously issued orders.

Landholdings with collective CLOAs issued and subsequently subdivided shall be reported separately in monthly DAR field office reports and included in the program for funding and monitoring purposes.
