The rules are known and cited as the "Rules and Regulations Governing the Investigation and Adjudication of Death and Disability Benefits of Uniformed Personnel of the Bureau of Fire Protection (BFP)".

These rules apply to claims for death and permanent total disability benefits of uniformed personnel of the BFP. Claims for temporary disability or sickness benefits are filed and acted upon under existing BFP rules.

Permanent Total Disability is a disability persisting for over 6 months without a fixed healing period that renders the BFP personnel incapable of performing duties. The 6-month waiting period may be waived if the disability is found permanent beyond doubt upon medical examination.

1. Injury must occur at the place of work while performing official functions. 2. If injury/death is elsewhere, the personnel must be executing a lawful order. 3. Injury/death must be by reason or while performing official duty.

The claim must be in writing and under oath, filed in triplicate, with: a. Recommendation by Fire Marshal. b. Authenticated Service Record. c. Medical certification unfit to perform duties. d. Detailed investigation report. e. Certified appointment copy. f. Clearance certificate. g. Leave credits certificate. h. Official receipts for medical and related expenses.

The BFP personnel himself or duly authorized representative may file a claim for permanent total disability. Death benefits claims may be filed by survivors under Section 3 of Resolution No. 2001-01.

Such claims shall not prescribe as long as they are filed strictly in accordance with the rules and regulations.

Claims are denied if injury, sickness, disability, or death is caused by: a. Intoxication or drug abuse. b. Willful self-injury or suicide. c. Notorious or culpable negligence. d. Unlawful aggression or provocation by the BFP personnel.

Reimbursement covers medical attendance, surgical operations, hospital stay, laboratory and diagnostic services, medicines and supplies within reasonable limits. Hospital room rates shall not exceed P1,800/day except in special cases. Medicines must have official receipts and doctor's prescriptions.

They shall be subject to criminal and administrative action as deemed appropriate by the Death and Disability Board.
