Q&A (EXECUTIVE ORDER NO. 360)

The Department of Agrarian Reform is granted the right of first refusal in the sale or disposition of agriculture-suitable lands owned by government financial institutions and government owned or controlled corporations.

The lands covered are those owned by government financial institutions and government owned or controlled corporations which are suitable for agriculture.

Proclamation No. 131 dated July 22, 1987, Executive Order No. 229 (Series of 1987), and Republic Act No. 6657 (Comprehensive Agrarian Reform Law of 1988) provide the basis for coverage of all public and private agriculture lands, including other lands of the public domain suitable for agriculture.

Section 1 of EO No. 229 states that CARP shall cover all public and private agriculture lands regardless of tenurial arrangement and commodity produced, and includes other lands of the public domain suitable for agriculture as applicable by law.

The Presidential Agrarian Reform Council is mandated to coordinate the implementation of CARP and is empowered to formulate and implement policies, rules, and regulations, both substantive and procedural, to carry out the objectives and purposes of the agrarian reform laws.

They are required to report to the Office of the President their compliance with the Executive Order and submit their present inventory of lands covered by the order within 30 days from the date of effectivity.

The Executive Order took effect immediately upon its issuance on June 9, 1989.

She exercised the powers vested in her by law as President of the Philippines to issue this Executive Order.

It ensures that lands owned by government entities suitable for agriculture can first be offered to the Department of Agrarian Reform to support the objectives of agrarian reform and land redistribution under CARP before being sold or disposed to other parties.
