The official title is the "Revised Implementing Rules and Regulations for the Higher Education Modernization Act of 1997" (IRR-HEMA '97).
The policy is to establish, maintain, and support a complete, adequate, and integrated system of higher education relevant to the needs of the people and society, and to ensure academic freedom for chartered State Universities and Colleges (SUCs).
The GBs are composed of the CHED Chair as Chairman, the SUC President as Vice Chairman, chairpersons of Congressional Committees on Education, Regional Directors of NEDA, representatives of faculty, students, alumni, private sector members, and appointed representatives from government agencies including DOST or DA depending on the SUC's focus.
Private sector members must meet qualifications set by the GB and are selected via a Search Committee constituted by the SUC President in consultation with the CHED Chairman. This committee submits at least five nominees, from which the GB selects two members, who then take an oath before assuming office.
They serve a term of two years and may be re-appointed for one additional term only.
They may fix tuition and other fees, adopt a socialized tuition scheme based on family income or socio-economic status, and such income constitutes special trust funds for use by the university or college.
The President is selected and appointed by the Governing Board upon the recommendation of a Search Committee for the Presidency (SCP) constituted by the GB.
The President must meet qualifications set by the GB, serve a four-year term clearly specified in the appointment, and is eligible for re-appointment for one additional term only.
The ADCO reviews and recommends policies governing administration and management. The AC determines and recommends course offerings, rules of discipline, and student admission and graduation requirements to the GB for approval.
All chartered SUCs enjoy academic freedom and institutional autonomy as provided under B.P. 232, R.A. 8292, and the 1987 Constitution, Article XIV, Section 5.
