Q&A (ERC Resolution NO. 05, S. 2008)

The purpose is to establish procedures, standards, and criteria for the issuance of a Certificate of Public Convenience and Necessity (CPCN) to entities engaged in the transmission and distribution of electricity.

A CPCN is an authorization issued by the government, allowing an entity to operate a public service that promotes the public interest in a proper and suitable manner.

The ERC conducted a public consultation on October 15, 2007, before adopting the rules.

The Resolution takes effect fifteen (15) days following its publication in a newspaper of general circulation in the Philippines.

Copies were furnished to the University of the Philippines Law Center-Office of the National Administrative Register (UPLC-ONAR) and all entities engaged in the transmission and distribution of electricity.

The PSC has the power to issue Certificates of Public Convenience and Necessity authorizing the operation of public service when it finds that the service promotes public interest properly and suitably.
