Question & AnswerQ&A (PROCLAMATION NO. 804)
The reserved land is a parcel containing 16,631 square meters located at Barangay La Filipina, Tagum City, Island of Mindanao.
The reserved cemetery site is under the administration of the City Government of Tagum.
The land shall be non-alienable and shall not be subject to occupation, entry, sale, lease or other modes of disposition until it is again declared alienable and disposable by the President through a formal disposition.
Non-alienable means the land cannot be sold, transferred, leased, occupied or otherwise disposed of by any person or entity unless the President declares it alienable and disposable again.
The land is bounded on the northeast and southeast by Road Lot 2; along other sides by Road Lot 1, with specific bearings and distances mentioned in the text, starting from a marked point and following survey lines accordingly.
The original survey was executed in April 1935 to May 1938 by Geodetic Engineer Eleuterio R. Paz. The subdivision survey was conducted on September 16, 1965 to March 20, 1966 by Geodetic Engineer Corsino L. Maquiling and approved on May 6, 1971.
The Proclamation reserves the land subject to any existing private rights. It does not affect such private rights unless otherwise provided by law.
The land can only be declared alienable and disposable again through another proclamation by the President of the Philippines specifying such disposition.
