EXECUTIVE ORDER NO. 167

: Republic Act No. 1700, entitled 'An Act to Outlaw the Communist Party of the Philippines and Similar Associations, Penalizing Membership Therein and for Other Purposes' was revived.
: The primary purpose of Republic Act No. 1700 is to outlaw the Communist Party of the Philippines and similar associations and penalize membership therein.
: Because the decrees unduly restricted the constitutional right to form associations.
: The Supreme Court case People vs. Ferrer (8 SCRA 382) found the Communist Party of the Philippines to be an illegal association working for the overthrow of the Philippine Government by armed struggle.
: The danger is that membership in subversive organizations like the Communist Party of the Philippines would no longer be punishable, posing a grave threat to the stability and existence of the Government.
: The Executive Order took effect immediately upon issuance on May 5, 1987.
: All laws inconsistent with the repeal, as well as presidential issuances, orders, rules, and regulations implementing these decrees, are likewise repealed or modified accordingly.
