The main purpose of Executive Order No. 907 is to direct the reorganization of the Philippine Tourism Authority (PTA) into the Tourism Infrastructure and Enterprise Zone Authority (TIEZA) to improve its operations and enable it to better pursue expanded services and functions.
The Philippine Tourism Authority was reorganized as TIEZA pursuant to Republic Act No. 9593, also known as the Tourism Act of 2009.
TIEZA is required to establish the most appropriate staffing pattern and qualification standards for all positions under the new structure. The revised organizational structure and staffing pattern must be approved by the TIEZA Board of Directors and the Department of Budget and Management (DBM).
Section 3 provides that the compensation plan of the reorganized TIEZA shall be comparable with prevailing compensation plans in the private sector to the extent practicable within the law, consistent with Section 105 of Republic Act No. 9593.
Republic Act No. 6656, also known as 'An Act to Protect the Security of Tenure of Civil Service Officers and Employees in the Implementation of Government Reorganization,' protects the security of tenure of employees affected by the reorganization.
Such employees are entitled to separation benefits provided under existing Civil Service laws or other laws or issuances beneficial to the employee, in addition to all gratuities and benefits they may be entitled to under the law.
Subject to approval of its Board of Directors, TIEZA may adopt and implement an incentive and assistance package for those who opt to voluntarily leave or retire from the service within a specified period and for those whose positions may be declared redundant, without prejudice to other existing benefits.
If any provision is declared unconstitutional, the remainder of the Executive Order shall remain in effect and not be affected.
Executive Order No. 907 took effect immediately upon its signing on June 16, 2010.
