In order to address difficulties in recruiting and retaining qualified lawyers, Executive Order No. 942 reorganizes the National Bureau of Investigation in the Philippines, upgrading salaries and streamlining positions to enhance effectiveness and responsiveness. The reorganization aims to promote efficiency in the service and is funded by salary savings within the NBI.

The primary reason was the low and non-implementation of the proper salary scale for lawyer positions in the NBI, which made it difficult to recruit and retain qualified lawyers, causing experienced NBI lawyers to leave for better-paying positions.

Salaries are as follows: NBI Chief Legal Officer - P43,392.00; NBI Assistant Chief Legal Officer - P41,392.00; NBI Chief Research Attorney - P41,392.00; NBI Senior Research Attorney - P33,840.00; NBI Research Attorney III - P32,196.00; NBI Legal Officer III - P32,196.00; NBI Legal Officer II - P27,732.00; NBI Legal Officer I - P25,116.00.

The Director is authorized to reorganize his legal and administrative staff within three months from the order’s effectivity in any manner deemed necessary to promote service efficiency.

They shall be paid the money value of their accumulated vacation and sick leaves, retirement gratuity under existing laws, or if they do not qualify for retirement benefits, one month salary per year of service payable in lump sum.

The amount necessary shall be taken from the salary savings of the National Bureau of Investigation.

Presidential Decree No. 1726 (mandate on salary scale), Presidential Decree No. 1416, as amended by Presidential Decree No. 1772, and the Constitution.

Upgrading salaries and streamlining positions aim to make the NBI more effective and responsive to its functions and objectives by attracting and retaining qualified legal personnel.

They will be entitled to receive the money value of their accumulated vacation and sick leaves and applicable retirement benefits or severance in accordance with the order’s provisions.
