The franchise granted to Subic Broadcasting Corporation under Republic Act No. 11000 is renewed for another twenty-five (25) years from the effectivity of the Act.
The franchise allows the construction, installation, establishment, operation, and maintenance of radio and/or television broadcasting stations, including digital television systems, through microwave, satellite, terrestrial, or any other means.
The grantee must secure the appropriate permits and licenses from the National Telecommunications Commission (NTC) and shall not use any frequency without authorization from the NTC.
The grantee must provide free public service time adequate for government announcements, provide sound and balanced programming, promote public participation, assist in public information and education, conform to ethical standards, promote audience empowerment such as through closed captioning, and refrain from broadcasting obscene content or deliberately false information.
Public service time shall be equivalent to a maximum aggregate of ten percent (10%) of the paid commercials or advertisements, which may be increased by the NTC during emergencies or calamities.
The grantee must comply with applicable labor standards under existing labor laws, rules, and Department of Labor and Employment issuances while considering the peculiarities of the broadcast industry.
The President may temporarily take over, suspend operation, or authorize government use of the stations in times of war, rebellion, public peril, calamity, emergency, disaster, or disturbance of peace and order, upon due compensation to the grantee.
The franchise shall be deemed ipso facto revoked if the grantee fails to operate continuously for two (2) years.
No, the grantee is prohibited from selling, leasing, transferring, granting usufruct, assigning, or merging the franchise or controlling interest without prior approval from Congress.
Failure to submit the annual report to Congress shall be penalized by a fine of Five Hundred Pesos (P500.00) per working day of noncompliance, to be collected by the NTC separately from other penalties.
