Executive Order No. 117 reconstitutes the Joint Enforcement and Monitoring Committee (JEMC) to supervise and implement the Peace Agreement between the Philippine government and the RPM-P/RPA/ABB, including the establishment of a Reintegration Fund to support former members' transition into mainstream society.

Questions (EXECUTIVE ORDER NO. 117)

It reconstitutes the Joint Enforcement and Monitoring Committee (JEMC) to implement the Peace Agreement between the GRP and RPM-P/RPA/ABB, provides for management of the Reintegration Fund, directs support from government agencies, and repeals EO No. 335 (Jan. 4, 2001).

The GRP and RPM-P/RPA/ABB entered into a Peace Agreement on Dec. 6, 2000; EO No. 335 (Jan. 4, 2001) constituted the original JEMC and created a Reintegration Fund; a Clarificatory Document was executed on Feb. 26, 2002.

It has two (2) members representing the GRP (designated/appointed by the President), two (2) members representing the RPM-P/RPA/ABB (nominated/designated by the group), and a fifth member chosen by the two sides from a list of persons of established integrity, impartiality, ability, and patriotism.

The JEMC elects from among themselves the Chairperson and Vice-Chairperson; the JEMC fixes the terms of the Chairperson and Vice-Chairperson.

OPAPP shall provide overall support in the management and operation of the JEMC.

The JEMC may create Local Monitoring Teams, technical working groups, and similar bodies, and may designate technical advisers to assist in implementation of the Peace Agreement and in performance of JEMC functions.

Examples include: (1) formulating and issuing Guidelines for implementation; (2) formulating schedules/work programs/plans; (3) coordinating/synchronizing government and RPM-P/RPA/ABB programs with LGUs/NGOs/communities; (4) resolving conflicts/problem areas; (5) gathering data, conducting investigations, generating reports, and directing proper authorities on substantial breach/violation; (6) conducting consultations; (7) disseminating timely information via an officially-designated spokesperson; (8) calling upon concerned agencies for assistance; and (9) doing other acts necessary for effective implementation.

It authorizes the JEMC to gather data, conduct investigations, generate reports, and direct proper authorities to undertake appropriate actions in case of any substantial breach or violation.

The JEMC must conduct free and honest ground-level consultations with major stakeholders and affected communities on issues and concerns arising from implementation of the Peace Agreement.

Through Section 2(h), the JEMC must disseminate proper and timely information on progress through an officially-designated spokesperson.

It is for programs/projects that assist alleged political offenders (APOs) who may be released from imprisonment under the Peace Agreement; specifically, to support reintegration into mainstream society and other development undertakings of former members of RPM-P/RPA/ABB.

It is Ten Million Pesos (₱10,000,000.00) and shall be sourced from the President’s Social Fund.

The JEMC shall formulate necessary guidelines for the management and utilization of the Fund, consistent with existing laws, rules, and regulations.

All agencies must provide support necessary to ensure timely and effective implementation of development projects/programs identified in the Peace Agreement, consistent with existing laws and policy thrusts on the peace process and national poverty alleviation agenda.

OPAPP shall provide the JEMC a permanent Secretariat for technical/administrative support and adequate office space and facilities.

DBM is directed to release ₱7,500,000.00 from the President’s Contingent Fund to initially cover operational expenses; succeeding years’ needs must be included in the OPAPP budget.

It expressly repeals Executive Order No. 335 dated Jan. 4, 2001 and also repeals or modifies any inconsistent orders, rules, regulations, or issuances or parts thereof.

It takes effect immediately upon approval.
