It reiterates mass housing as a centerpiece program in poverty alleviation and further strengthens the Housing and Urban Development Coordinating Council (HUDCC) so it can effectively and efficiently discharge its role as the sole lead agency in implementing the government’s shelter/housing programs.
HUDCC assists the President and the Presidential Commission for Mass Housing (PCMH) in formulating and implementing national objectives, policies, and strategies for housing and urban development, and it coordinates and monitors housing activities of government entities to ensure attainment of housing goals.
Among others: (1) serve as the sole lead agency assisting the President/PCMH in formulation and implementation of housing objectives, policies, and strategies; (2) coordinate and monitor government agencies/LGUs’ housing projects; (3) encourage maximum private sector participation; (4) formulate basic policies/guidelines on disposal or development of acquired/existing assets of key housing agencies not required for their mandates; (5) identify and secure local/foreign funding; (6) give directions to HLURB for rational land use; (7) recommend new legislation/amendments; and (8) undertake other functions under existing laws.
It directs HUDCC to coordinate and monitor activities of all government agencies, including local government units, that undertake housing projects to ensure accomplishment of goals of the government’s housing program.
HUDCC is directed to encourage the maximum participation of the private sector in all aspects of housing and urban development.
HUDCC shall provide directions to HLURB to ensure rational land use for the equitable distribution and enjoyment of development benefits.
The agencies are NHA, NHMFC, HDMF, HLURB, and HGC. They remain attached to HUDCC for purposes of policy and program coordination, and they must provide manpower, logistical support, and other facilities to the Office of the Chairman as necessary.
The Chairman is appointed by the President, has the rank of a Department Secretary, is a regular member of the Cabinet, and reports directly to the President.
The Chairman is ex officio Chairman of the governing boards of NHA, NHMFC, HDMF, and HLURB, and Vice-Chairman of HGC.
The EO grants the Chairman exclusive powers such as recommending to the President appointments/acts over board members/CEOs, exercising for and in behalf of the President administrative supervision, overseeing operations for efficiency/effectiveness/economy, requiring reports and audits/inspections, reviewing agreements/investments, recommending flagship projects, recommending changes in organizational structure, recommending budgets approval to the President, and more. While some actions require recommendations to the President, the Chairman can also exercise administrative supervision and oversight as provided by the EO.
It requires submission of audited financial statements within 60 days after the close of the fiscal year, to allow proper evaluation and preparation of recommendations to the President.
It is a compliance and accountability mechanism: the Chairman may require them to ensure compliance with HUDCC policies, standards, and guidelines.
The Secretariat monitors and evaluates financial, physical, and organizational performance; reviews contracts, joint venture agreements, memoranda of agreements, investments, borrowings, creation of subsidiaries, and similar agreements; and provides recommendations to the President based on its review.
The Secretary General assists the Chairman in day-to-day management and operations and implements policies and measures approved by the Chairman. The Secretary General is under the direct control and supervision of the Chairman.
It grants continuing authority—consistent with existing laws—for the Chairman to reorganize the HUDCC Secretariat.
It imposes a directive/condition that all departments, agencies, bureaus, instrumentalities, including GOCCs, implementing housing projects must seek clearance and approval of the HUDCC Chairman for their respective housing and related projects.
Separability means if any provision is declared invalid, the rest remain valid. Repealing means inconsistent executive/administrative issuances (or parts) are repealed or modified accordingly.
It takes effect immediately upon adoption/effectivity, meaning its organizational, supervisory, and coordination directives apply at once to the HUDCC and attached housing agencies.
