Title
Insurance Benefits for Barangay Officials EO 250
Law
Executive Order No. 250
Decision Date
Jul 25, 1987
An executive order in the Philippines enhances the insurance benefits of local government officials to better support their responsibilities, providing coverage for death, total and permanent incapacity or disability, and specific benefits for injuries resulting from accidents occurring during their incumbency. Premiums will be adjusted based on actuarial studies and the Government Service Insurance System will oversee the implementation of this order.

Questions (EXECUTIVE ORDER NO. 250)

EO 250 covers (1) every Punong Barangay, (2) Sangguniang Barangay member, (3) Chairman of the Kabataang Barangay, (4) Barangay Secretary, and (5) Barangay Treasurer, and (6) every member of the Sangguniang Panlalawigan, Sangguniang Panlungsod, and Sangguniang Bayan, duly elected or appointed and duly qualified, who do not receive fixed salary or compensation.

Coverage ceases the moment the official receives fixed salary or compensation in the same capacity or by virtue of a permanent appointment in any government office, or by election to another public office, after which the official is covered under the appropriate law.

If a covered official dies during incumbency (work-connected or not): beneficiaries of (1) a Punong Barangay or (2) a member of the Sangguniang Panlalawigan/Panlungsod/Bayan are entitled to ₱7,000, while beneficiaries of (1) a Sangguniang Barangay member, (2) Barangay Secretary, (3) Barangay Treasurer, or (4) Chairman of the Kabataang Barangay are entitled to ₱5,000. A burial benefit of ₱1,000 is also paid.

No. Under Section 2, death benefits are payable regardless of whether the cause of death is work-connected or not.

For total and permanent incapacity/disability: (1) Punong Barangay or a member of the Sangguniang Panlalawigan/Panlungsod/Bayan gets ₱5,000, and (2) a member of the Sangguniang Barangay, Barangay Secretary, Barangay Treasurer, or Chairman of the Kabataang Barangay gets ₱3,000. A burial benefit of ₱1,000 is payable to beneficiaries only if death occurs within one year from the onset of the disability.

No. Section 3 provides that anyone availing of benefits under Section 3 cannot benefit from Sections Two, Four and Five.

EO 250 provides benefits for injuries from accidents occurring during incumbency whether work-connected or not. For persons covered under Section 4 (Punong Barangay and members of higher sanggunians), the benefits follow a schedule and 'in no case shall exceed' ₱5,000 per covered year. For persons covered under Section 5 (Sangguniang Barangay members and certain barangay officials), the maximum is ₱3,000 per covered year.

Yes. Sections 4 and 5 both state that injury benefits apply 'whether work-connected or not,' as long as the accident occurs during incumbency.

The schedule includes: loss of sanity from injury to the brain; permanent loss of sight (both eyes, or one eye); permanent loss of sense of hearing (both ears, or one ear); loss/destruction of limbs (two or more; one limb); loss/destruction of hands (both at/above wrist; one at/above wrist); loss/destruction of feet (both at/above ankle; one at/above ankle); loss/destruction of thumb/great toe; and loss/destruction of every finger/toe. It also covers other injuries requiring hospitalization for at least 40 days (or less than 40 days subject to the GSIS rule amounts) and other injuries not requiring hospitalization but requiring medical attention for at least 15 days (or less than 15 days subject to GSIS rule amounts).

If other laws provide similar benefits for the same contingencies, the official or beneficiaries who qualify may choose which benefit will be paid. This prevents automatic stacking of benefits for the same contingency.

No benefit is allowed if the injury, sickness, disability, or death was occasioned by (1) intoxication, (2) willful intention to injure or kill oneself or another, or (3) notorious negligence.

The national government appropriates annually and includes in the General Appropriations Act the total annual premiums based on actual number of officials covered as certified by the Department of Local Government. The annual premiums are ₱110 for each Punong Barangay and each member of the Sangguniang Panlalawigan/Panlungsod/Bayan; and ₱48 for each Sangguniang Barangay member, Barangay Secretary, Barangay Treasurer, and Chairman of the Kabataang Barangay.

GSIS conducts periodic actuarial studies to determine adequacy of contributions and may recommend adjustments. If premiums are adjusted, the total annual premium based on the adjusted rates—certified by GSIS—is then provided in the General Appropriations Act for subsequent years.

No. Section 6 expressly states that any failure or delay in payment of premiums shall not prejudice the efficacy and enforceability of the insurance benefits.

Up to a maximum of 12% of the annual premiums may be disbursed by GSIS for administrative and operations expenses.

Only to the extent that would affect enforcement of EO 250, inconsistent executive orders, rules, and regulations (or parts thereof) are amended or modified accordingly.
