Questions (PRC BOARD OF OPTOMETRY Resolution NO. 04, S. OF 2007)

The PRC Board of Optometry is empowered to “adopt, promulgate, and disseminate the Code of Ethics for the practice of optometry in the Philippines” under Sec. 12 (Functions and Powers of the Board) of R.A. No. 8050.

The Board shall adopt the Professional Code of Ethics prescribed by the Integrated Philippine Association of Optometrists, Inc. (IPAO), as stated in the resolution (citing Sec. 40—Code of Professional Ethics under the Revised Optometry Law).

The resolution states that IPAO is recognized by the Board and the PRC pursuant to Section 36 of R.A. No. 8050 and Board Resolution No. 2, Series of 1998.

The resolution states that IPAO submitted the Code to the Board on June 5, 2006.

The Board adopted and promulgated the Professional Code of Ethics for Optometrists prescribed by IPAO, with the text of the Code attached as Annex “A.”

Annex “A” contains the text of the Professional Code of Ethics for Optometrists; it is “attached” to the Resolution and is “made and integral part thereof.”

It takes effect after fifteen (15) days following its complete and full publication in the Official Gazette or in any newspaper of general circulation in the Philippines.

Complete and full publication in the Official Gazette or in any newspaper of general circulation in the Philippines.

The resolution is signed by Chairman Divina Lourdes R. Reyes and members Rosalinda B. Bono, Anita S. Villarta, and Teresita H. Marcaida. Their signatures indicate official Board adoption of the resolution.

Carlos G. Almelor, Secretary, Professional Regulatory Boards, attested to the Resolution—meaning he certified/confirmed the authenticity of the action taken.

It was approved by Leonor Tripon-Rosero (Chairperson), Ruth Raaa Padilla (Commissioner), and Nilo L. Rosas (Commissioner). The “Approved” portion indicates approval by the PRC Commissioners/Chairperson for it to be effective as a PRC issuance.

Copies must be given to IPAO and other affiliate optometry associations for dissemination to their members, and to all schools/colleges/universities offering optometry for use of their graduates and students.

The Code is intended for use by optometrists (members of associations) and for incorporation in training/education—specifically for graduates and students in optometry schools/colleges/universities.

Adopted on September 19, 2007, shown near the signatures of the Board members.

The resolution is an implementing issuance that exercises authority under R.A. No. 8050—specifically citing Sec. 12 (Board powers) and Sec. 40 (Code of Professional Ethics)—to adopt IPAO’s Code.

Because the legal binding force of the Resolution depends on compliance with the publication requirement; effectivity occurs only after the specified 15-day period following complete and full publication.
