This Executive Order governs the approval process for all BOT and similar proposals on water supply projects.
The Local Water Utilities Administration (LWUA) shall be the implementing agency when a BOT project encompasses the service area of more than one water district.
For a BOT project intended for a lone water district classified as Large or Very Large, the water district concerned shall be the implementing agency.
For water districts not classified as Large or Very Large, the Local Water Utilities Administration (LWUA) shall be the implementing agency.
The private sector proponent must present a written document signifying its interest to the water district, which must include the company profile, specifics of the intended project, and source of funding.
The MOU must be non-exclusive, at no cost to the water district, and have a validity period for submission of a proposal not exceeding six (6) months, depending on the project complexity.
The evaluation is undertaken by the implementing agency's Prequalification, Bid and Awards Committee for BOT Projects.
The water district must conduct a project presentation with a public hearing to determine the social and financial acceptability of the proposed project.
LWUA makes a preliminary review of the project proposal based on the evaluation by the water district's Prequalification, Bid and Awards Committee before the proposal is submitted for preliminary review by NEDA.
LWUA conducts its final review after the water district's Board of Directors has approved the proposal.
Providing LWUA with these documents ensures that its review of the proposal has sufficient and accurate information for proper evaluation.
Executive Order No. 68 took effect immediately upon its signing on February 10, 1999.
