A non-refundable processing fee of P5,000.00 shall be collected for each application filed with the Legal Office of the Office of the President.
The application must be under oath and state the exact site of excavation, reasons for concluding hidden treasure is present, nature and estimated value of the treasure, extent of excavation work and its estimated cost, potential damage to the site, and the proposed restoration program with estimated cost.
The vicinity/location plan must be duly certified by a licensed Geodetic Engineer or Surveyor, specifically pinpointing and delineating the exact site and affected parcel boundaries.
The excavation site shall not exceed One (1) hectare for land or Two Hundred Thousand (200,000) square meters for bodies of water.
The applicant must post a bond to guarantee the restoration of the excavation site, to be obtained from the Government Service Insurance System or any other reputable bondsman if the former fails to provide it.
The permit shall be valid for three (3) months but may be extended for another three (3) months for valid reasons.
The Head of the Legal Office, presently the Assistant Executive Secretary for Legal Affairs, is designated as the authorized signatory for the contract.
A three-member committee composed of the Commander of the Presidential Security Group or representative, a representative designated by the Applicant, and a Filipino citizen as chairman appointed by the first two members.
Seventy-five percent (75%) of the treasure shall go to the GOP and twenty-five percent (25%) to the Applicant.
The GOP reserves the right to enter into similar contracts with other persons and does not confer exclusive rights to the Applicant unless the Applicant has started excavation; thereafter, no other contracts will be entered into near or within the site unless the Applicant abandons operation or the contract expires.
