The fees required are: a filing fee of P100.00 per application/proposal, a processing fee of P5,000.00 per application/proposal, and a P.D. 1856 as amended fee of P20.00 per application/proposal.
An individual must submit certified photocopies of Income Tax Returns for the three immediate preceding years, proof of sufficiency of capital and/or credit lines, a sworn statement that the applicant is not a dummy of any person or entity, and authorization to the Secretary of the DENR or his representatives to verify information submitted.
They must submit a two-year exploration work program and commit in writing to conduct an Environmental Impact Assessment (EIA) and comply with the requirements of Environmental Compliance Certificate (ECC) before actual mining operations start.
Failure to submit the LOI and MPSA within two years from the effectivity of DENR A.O. 57 or until July 17, 1991, shall cause the abandonment of mining, quarry, and sand and gravel claims.
The occupation fee is ten pesos per hectare for non-reservation area and one hundred pesos per hectare for reservation area payable within fifteen days from receipt of the written notice.
Survey returns must be submitted to the Regional Executive Director within one year from receipt of the order of survey.
The RED shall publish the MPSA application/proposal once a week for two consecutive weeks in a newspaper of general circulation at the applicant's expense and cause its publication on the bulletin boards of the Mines and Geosciences Bureau, the municipal building, and the DENR Regional Office, each for two consecutive weeks.
It must be verified, accompanied by the prescribed docket fee and proof of service upon the respondent, contain the names of adverse claimants and their counsel if any, detailed statements of facts, grounds for the claim/protest, and all supporting documents.
The minimum verification fee is P4,000, which includes payment of P1,000 per man per day for the geologist/mining engineer and geodetic engineer deputized by the DENR Regional Executive Director.
The Negotiating Panel handles the final evaluation and negotiation of applications with capital investments of at least one hundred million pesos.
Applicants must be already operating or about to operate, have submitted a proposed MPSA, and submitted an approved work program, surety bond, and Environmental Compliance Certificate (ECC). They must also submit quarterly progress production reports for share computation.
The remaining parts of the guidelines shall not be affected by such declaration due to the separability clause.
It takes effect fifteen (15) days after its publication in a newspaper of general circulation.
