The Metropolitan Manila Development Authority (MMDA) establishes rules for the confiscation and public auction of items obstructing sidewalks, imposing fines for violations to ensure pedestrian safety and clear public spaces.
A

Q&A (MMDA Resolution NO. 02-40)

The fine is ONE HUNDRED FIFTY PESOS (P150.00) in addition to confiscation/forfeiture of the items and dismantling of illegal structures.

Prohibited acts include vending or selling various goods, conducting shoe-shine occupations, religious activities on sidewalks, house chores like washing clothes, vehicle repair, dumping garbage, setting up basketball courts, installation of fences, and storage of construction materials among others.

The fine must be paid within seven (7) days from the date of apprehension.

If the fine is not paid within seven days, the confiscated items shall be disposed of in a public sale, with proceeds applied to the fine, auction costs, and any excess returned to the owner.

The MMDA Auction Committee administers the disposal of confiscated items through public auction.

The Committee appraises items to set floor prices, fixes the auction's time, date, and place, publishes notices in newspapers and conspicuous places, and conducts public auctions with at least two bidders. Failed bids lead to negotiated sales after two attempts.

The winning bidder must deposit 20% of the bid amount and pay the balance within three (3) days from the sale date.

The bid is cancelled, and the 20% deposit is forfeited in favor of the MMDA.

The items must be taken out within seven (7) days from the date of the auction.

The sale is null and void, and payment made by the buyer is forfeited to the MMDA.

Confiscated items include non-perishable goods, commodities, merchandise, vending paraphernalia, equipment and facilities, pedicabs, pushcarts, steel railings, and similar items.

It took effect fifteen (15) days after its publication in two newspapers of general circulation in Metro Manila.
