The primary purpose is to ensure that Customs Bonded Warehouses (ICBWs) are not used as conduits to avoid lawful duties and taxes and to prevent smuggling through the warehousing scheme.
The Special Assistant for Warehousing and Operations, Office of the Commissioner is tasked to form the Audit Team.
The Audit Team is authorized to require ICBW Operators to produce necessary documents related to imports and exports, manufacture formula, company profile, and other pertinent audit documents.
Failure to produce requested documents will be deemed as if no such documents exist.
They must provide the Account Officer’s Record of Importation, exportation, and related documents attached thereto.
The Bonds Division shall provide the Audit Team with a certified list of open entries of the ICBW under audit.
The Audit Team must submit a comprehensive and detailed report including recommendations within 30 days from the issuance of the Mission Order.
Recommendations may include issuance of demand letters, suspension of warehousing privileges, placing future importations under Section 1508 of the TCCP, revocation of licenses, and prosecution for criminal liability.
Section 1508 of the Tariff and Customs Code of the Philippines (TCCP) is referenced for stricter control of future importations.
This Order takes effect immediately upon issuance and remains in force until revoked.
